1) The project is consistent with the applicable general plan designation and all applicable general plan policies, as well as with the applicable zoning designation and regulations; 2) The proposed development occurs within City limits on a project site of no more than five acres substantially surrounded by urban uses; 3) The project site has no value as habitat for endangered, rare, or threatened species; 4) Approval of the project would not result in any significant effects of relating to traffic, noise, air quality, or water quality; and 5) The site can be served by all required utilities and public services

Reasons for Exemption
The City Navigation Center (“Project”) is statutorily exempt from CEQA as it is a ministerial project. (State CEQA Guidelines section 15268.) The Project constitutes a low barrier navigation center pursuant to Government Code section 65660. The site is zoned Public Facilities (PF) and the Project complies with the requirements of Government Code section 65662. As such, the Project is permitted by right and is exempt from CEQA. Additionally, the Project is statutorily exempt as an emergency project pursuant to Public Resources Code section 21080(b)(4) and State CEQA Guidelines section 15269, as it will mitigate the homeless state of emergency that exists in the City, as declared in Resolution No. 2023-028 and reaffirmed by the City of San Bernardino Mayor and City Council at the duly noticed MCC hearing on September 9, 2024, with Resolution No. 2024-201
