Document Description
The California Department of Fish and Wildlife (CDFW) has executed Lake and Streambed Alteration Agreement EPIMS Notification No. EPIMS NAP-55603-R3, pursuant to Section 1602 of the Fish and Game Code, to the Town of Yountville. The Project is limited to installation of approximately 2,200 linear feet of 8-inch diameter, high density polyethylene (HDPE) pipe using horizontal directional drilling (HDD) methods in order to restore recycle water conveyance services and replace an existing 6-inch diameter polyvinyl chloride (PVC) pipe that was rendered unusable following a collapse in February 2023. Following installation of the new HDPE water main, the temporary repair will be decommissioned and removed completely from the site, and the original 6-inch diameter PVC main pipeline will be capped on either end at the two open trench HDD tie-in points, but will remain buried beneath the Napa River. No cementitious materials will be used to fill the existing pipeline. The Project will investigate the broken pipe’s condition, location, and depth. If the pipeline is determined to be located within the stream scour zone, an amendment to the Agreement will be required to include additional activities to remove the pipe potentially including but not limited to dewatering. If the existing pipeline is determined to be located outside of the stream scour zone, the capped pipeline will be left in place, and the Permittee will continue to monitor the existing pipe location on an annual basis to ensure it does not impede flow for the full term of the Agreement.

Reasons for Exemption
On August 22, 2024, the Town of Yountville Public Works Department, the Lead Agency, determined that the Project is categorically exempt pursuant to California Code of Regulations, title 14, section 15302. The Lead Agency determined that the Project meets certain qualifying criteria for the exemption. Pursuant to Public Resources Code section 21080.1, subdivision (a), the Lead Agency is responsible for determining whether the Project is exempt from CEQA and that determination shall be final and conclusive on all persons, including Responsible Agencies. As a result, CDFW, acting as a Responsible Agency, is bound by the Lead Agency’s determination that the Project is exempt from CEQA.
