Document Description
The proposed project consisted of the update of both the Open Space and Conservation Elements in order to comply with Senate Bill (SB) 1425 and Assembly Bill (AB) 1889, respectively. The policies, plans, and actions of the respective elements were updated to equitable access to open space considering social, economic, and racial equity; climate resilience and other benefits coordinated with the Safety Element; rewilding opportunities to preserve and enhance natural ecosystems; impacts of development on wildlife movement and habitat connectivity; identification and analysis of connectivity areas, permeability, and natural landscapes; and incorporation of guidelines, standards, and best available practices. No specific projects were proposed as part of the update.

Reasons for Exemption
The proposed project consists of the update to the City of Lancaster Open Space and Conservation Elements (formerly Plan for Active Living and Plan for the Natural Environment) in accordance with SB 1425 and AB 1889. The updates do not grant any land use entitlements or authorize any construction approvals. As such, no physical change to the environment would occur as a result of the project. Future development within the City would be subject to the applicable objectives and policies contained within the General Plan, including the updates, and subject to the appropriate level of CEQA review. Since no physical changes to the environment would result from the approval of the agreement, the project is exempt under Section 15061(b)(3), the Common Sense Exemption, which states “Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA”.
Additionally, under Public Resources Code section 21166 and CEQA Guidelines section 15162(a), once an Environmental Impact Report has been certified, no further environmental review is necessary unless there is a change to the project or its circumstances, or new information becomes available that would lead to new or more significant environmental impacts. The proposed actions were reviewed for compliance with CEQA), and staff determined that they were previously evaluated in the Final Environmental Impact Report for the City of Lancaster General Plan 2030 (SCH# 200711003), which was certified by the City Council on July 14, 2009.
