Reasons for Exemption
The project involves constructing a new single family residence, elevated deck, new vehicular access, grading, landscaping, and a spa on a single lot to be merged from three adjoining lots. A coastal development permit is required for development in the coastal zone. A variance is requested to encroach into a mapped watercourse setback and to not provide the required on-site turnaround. A revocable encroachment permit is requested to construct a retaining wall within the public right-of-way in the R-1 (residential Low Density) Zoning District. No evidence has been presented to demonstrate that there is a reasonable possibility that the proposed project will have a significant effect on the environment due to unusual circumstances. In accordance with the California Environmental Quality Act (CEQA), the recommended action is exempt from further review per State CEQA Guidelines Section 15303, Class 3(a), New Construction. Class 3(a) allows for one single-family residence, or a second dwelling unit in a residential zone. In urbanized areas, up to three single-family residences may be constructed or converted under this exemption. The project involves constructing a new single-family residence, elevated deck, new vehicular access, grading, landscaping, and a spa on a single lot to be merged from three adjoining lots. A coastal development permit is required for development in the coastal zone. A variance is requested to encroach into a mapped watercourse setback and to not provide the required on-site turnaround. A revocable encroachment permit is requested to construct a retaining wall within the public-right-of-way in the R-1 (residential Low Density) Zoning District. No evidence has been presented to demonstrate that there is a reasonable possibility that the proposed project will have a significant effect on the environment due to unusual circumstances, and therefore is exempt from CEQA. None of the exceptions to the categorical exemptions identified in CEQA Guidelines, section 15300.2 applies. There is nothing unusual about the project site or the project itself that would lead to a potentially significant impact. And, even if an unusual circumstance did exist (one does not), there is no reasonable possibility that the project would have a significant effect on the environment. The project site is zoned for single-family development and provides adequate off-street parking. Further, the project will not result in damage to scenic resources within a highway officially designated as a state scenic highway; the closest officially designated state scenic highway is located near Anaheim and therefore the project will not result in damage to scenic resources within or near such highway. Further, the project is not located on a site which is included on any list compiled pursuant to Government Section 65962.5; the project site has not been designated as a hazardous waste site. Further, the project will not cause a substantial adverse change in the significance of a historic resource. Thus, the Class 3 categorical exemption applies.
