Reasons for Exemption
In accordance with the California Environmental Quality Act (Public Resources Code, §§ 21000 et seq., "CEQA"), the proposed amendments to the previously adopted Mixed-Use Overlay Zone are exempt from environmental review under the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq., ('CEQA') and the CEQA Guidelines (14 California Code of Regulations §§ 15000, et seq.) because the amendments consist of revisions to the minimum density standard and definitions of terms. The amendments do not change the existing allowable maximum densities and allowable uses, which were previously analyzed as part of an Environmental Impact Report for the Housing Element and the Mixed-Use Overlay Zone when it was first introduced and adopted. The amendment, therefore, is exempt from the requirements of CEQA under CEQA Guidelines Section 15061(b)(3), because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.
