Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Section 15301, Class 1 (Existing Facilities) & Section 15333, Class 4 (Small Habitat Restoration Project)
Reasons for Exemption
The project proposes minor grading and earthmoving activities associated with the removal of 0.1 acres of planted vineyard from an existing 1.1 gross acres (0.6 net acres) vineyard. The remaining vineyard (0.8 gross acre, 0.5 net acres) would not require additional work beyond ongoing maintenance of existing erosion control measures. The 0.1 acres of vineyard was planted within the County required stream setback without a permit, which will be restored resulting in consistency with Napa County Conservation Regulations, and would restore native vegetation that would support local wildlife. The area to be disturbed is not situated on a recognized hazardous waste site or in a biologically sensitive area and would not exacerbate any known landslide. This replant of existing vineyard developed will not adversely affect cultural or scenic resources, or substantially interfere with the movement of wildlife. In addition, it will not contribute to increases in local off-site stream flows or sediment levels, reductions in groundwater recharge, groundwater levels, or available wildlife habitat, or changes in other environmental parameters. Finally, there are no unusual circumstances associated with the removal of vineyard and restoration that would cause it to have a significant effect on the environment (see project file in the office of the Napa County Planning Building & Environmental Services Department for the documentation supporting these conclusions).
