Document Description
The California Department of Fish and Wildlife (CDFW) has executed Lake and Streambed Alteration Agreement EPIMS Notification No. EPIMS- MAN-61136-R3, pursuant to Section 1602 of the Fish and Game Code to William Stockard, Marin County – Flood Control and Water Conservation District.
The Project is limited to clearing sediment and vegetation from two existing culvert outfalls to increase flow capacity and reduce localized flood risk. To complete this work the Project will use an excavator and dump truck from the Seminary Drive road right of way, and hand tools within the tributaries which include wetlands. No heavy equipment will be used within the tributaries. Work will occur during low tide events; however, the use of temporary dewatering and water exclusion techniques may be necessary to block off incoming tide water to the Project area. There will be no riparian trees removed, however trimming of tree branches may occur and will be limited to no greater than approximately 15 percent of the canopy of the tree. The Project will result in 1,351 square feet (234 linear feet) of temporary impacts to stream and connected wetland habitat associated with sediment and vegetation removal activities. The Project will not result in any permanent impacts.

Reasons for Exemption
On July 29, 2025, the Marin County Department of Public Works, the Lead Agency, determined that the Project is categorically exempt pursuant to California Code of Regulations, title 14, sections 15301 and 15304. The Lead Agency determined that the Project meets certain qualifying criteria for the exemption. Pursuant to Public Resources Code section 21080.1, subdivision (a), the Lead Agency is responsible for determining whether the Project is exempt from CEQA and that determination shall be final and conclusive on all persons, including Responsible Agencies. As a result, CDFW, acting as a Responsible Agency, is bound by the Lead Agency’s determination that the Project is exempt from CEQA.
