Document Description
On October 23, 2025, the City received emergency authorization from the U.S. Army Corps of Engineers (USACE) Regional General Permit (RGP) 63 Section 408 permission (SPL-2025-00882) to conduct removal of accumulated debris and sediment from three culverts that convey water flow under U.S. Highway 101 to the Laguna Channel in order to prevent loss of property and life during storm events. The proposed emergency scope of work consisted of dewatering an area of approximately 30 feet by 60 feet within the channel, sediment removal, collection and disposal of approximately 1,300 cubic yards of silt and solids from the 3 existing box culverts located under U.S. Highway 101. All collected solid materials were disposed of offsite at a landfill. The upper portion of Laguna Channel that bisects Assessor’s Parcel Number (APN) 017-630-005 and APN 017-540-006. APN 017-540-006 is a City owned parcel. APN 017-630-005 is owned by Yanonali Street Holdings, LLC, which the City has a flood control easement agreement on file with the County of Santa Barbara’s Assessor’s office. Public Works received an emergency CDP to perform the work in the coastal zone.

Reasons for Exemption
This emergency Project meets the § 15269 (c) Emergency Projects statutory exemption as the emergency culvert clearing work was essential to restore the capacity of the culverts prior to the rainy season to not create a threat to life and property and potential flooding risk. If high-risk waterways are not cleared before the rainy season, flooding may occur that could result in a loss of property and life. Urgent removal of silt and sediment was necessary to prevent an emergency situation of this high-risk waterway.
