Reasons for Exemption
CEQA does not apply to prescribed fire, reforestation, habitat restoration, thinning, or fuel reduction projects, or to related activities included in the project description, undertaken, in whole or in part, on federal lands to reduce the risk of high-severity wildfire that have been reviewed under the federal National Environmental Policy Act of 1969 if a state or local agency is undertaking those projects pursuant to the federal Good Neighbor Authority or a stewardship agreement with the federal government entered into pursuant to Public Law 113-79.
The proposed projects were reviewed in their entirety under the following: Yuba Ranger District, Tahoe National Forest NEPA, Western Nevada County Community Defense Project - Deer Creek EA and FONSI (2016); Yuba Ranger District, Tahoe National Forest NEPA, South Yuba Roadside Fuel Break CE (2025), Tahoe Ranger District, Tahoe National Forest NEPA, Truckee Ranger District Roadside Fuel Break Expansion DM (2023), and Tahoe National Forest, Nevada City Ranger District Washington Fuels Reduction Project DN/FNOSI (2004) .
