Class 1 consists of the operation, permitting, and licensing of an existing public or private structure, involving negligible or no expansion of an existing or former use. The proposed project consists solely of a time extension for Use Permit No. 04-UPB-0230 and Reclamation Plan No. 04-REB-0229 to allow the continued operation of an existing pre-wash facility, associated settling ponds, and grading activities, as well as to extend the deadline for implementation of the approved Reclamation Plan. No new construction, modification, or expansion of facilities or site activities is proposed. Since the project will involve no expansion of an existing use, the project is exempt from the provisions of CEQA.
