Reasons for Exemption
Project is exempt, consistent with the California Environmental Quality Act of 1970 (CEQA) and the State CEQA Guidelines, pursuant to Title 14, Cal. Code Regulations Section 15303, Class 3 pertaining to New Construction or Conversion of Existing Structures. The use of Section 15303, Class 3, is applicable and appropriate as the intent of the project is to create new residential parcels and a remainder. The division will not result in any physical changes and will only create new property boundaries. In addition, three of the resulting parcels will be vacant and would allow for new construction under the Tulare County Zoning Ordinance if the project is approved. The division of land does not allow for the number of structures on the resulting parcels to exceed the maximum allowable on any legal parcel.
