Reasons for Exemption
Class 1 Existing Facilities: The project qualifies under State Section 15301 and County Class 1 because the project consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The types of “existing facilities” itemized below are not intended to be all-inclusive of the types of projects which might fall within Class 1. The key consideration is whether the project involves negligible or no expansion of use. The addition of some equipment on and near an existing utility pole would fall within a negligible expansion of the use. The Project qualifies for a Class 1 negligible expansion of the use exemption because the addition of equipment on an existing pole would 1) not change the use of the pole, 2) not expand the footprint of the utility pole, 3) not impact or change the use of any existing equipment already on the existing poles, and 4) not cause any disturbance beyond the existing already graded and developed area around the existing pole. Class 2 Replacement or Reconstruction: The project qualifies under State Section 15302 and County Class 2 because the project results in replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. The Project qualifies for a Class 2 exemption because at least one site includes equipment replacement. Class 3 New Construction or Conversion of Small Structures: The project qualifies under State Section 15303 and County Class 3 because the project includes construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. The numbers of structures described in this section are the maximum allowable on any legal parcel. The Project qualifies for a Class 3 exemption because each site includes the addition of small broadband equipment and/or utility cabinets, and no new buildings or large structures are proposed. Class 4 Minor Alterations to Land: The project qualifies under State Section 15304(f) and County Class 4(k) because the project may include minor alterations to land requiring excavation, trenching, backfilling and surface restoration associated with the installation of the fiber optic cables. Class 11 Accessory Structures: The project qualifies under State Section 15311 because the project includes construction or placement of minor structures accessory to (appurtenant to) existing commercial, industrial or institutional facilities, such as utility cabinets. In addition, based on the record, the project complies with all applicable regulations, no significant impacts to sensitive environments, no significant cumulative impacts associated with successive projects of the same type within the project footprint were identified, it would not result in unusual circumstances or damage to scenic highways, the project site is not listed on hazardous waste site lists compiled pursuant to Government Code section 65962.5, and there are no indications that the project may cause a substantial adverse change in the significance of a historic resource that would make the exemptions inapplicable.
