Reasons for Exemption
The Class 1 Categorical Exemption consists of the operation, repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. Under the Amended and Restated Alameda Corridor Use and Operating Agreement which governs use and operation of the Alameda Corridor, mutual agreement for certain use and operational decisions require the approval from at least three parties: the Port of Long Beach, Port of Los Angeles, BNSF Railway Company, and Union Pacific Railroad. Approval of Mutual Agreement 2025-2 approves an annual maintenance and capital improvement plan for the existing Alameda Corridor. The plan consists of the Maintenance of Way Budget in the amount of $37,966,876.54 for anticipated maintenance and capital costs to be incurred in the upcoming year and the overall Operations and Maintenance Budget in the amount of $49,585,511.06 which includes the Maintenance of Way Budget, other operations and maintenance expenses, and a $500,000 contingency for unanticipated operations and maintenance items.
