Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement EPIMS Notification No. EPIMS-MEN-55722-R1C, pursuant to Section 1602 of the Fish and Game Code to Allan Barr. This Agreement is in response to violations of Fish and Game Code section 1602 documented during a CDFW search warrant on June 19, 2024, and relies on the Notification materials, a CDFW site visit on June 24, 2025, and correspondence with Permittee’s representative. The Project is limited to six (6) encroachments. Encroachment 1 is for water diversion from a horizontal well on an unnamed tributary to Mill Creek (POD) for domestic use. Encroachment 2 (Stream Crossing #1), Encroachment 4 (Stream Crossing #3), and Encroachment 5 (Stream Crossing #4) arefor upgrades to existing crossings. Encroachment 3 (Stream Crossing #2) and Encroachment 6 (Map Point #5) are to decommission existing crossings and remediate the native stream channel.

The Barr Water Diversion, Stream Crossings, and Stream Restoration Project (Project) meets the criteria for categorical exemption type Class 1; California Code of Regulations, title 14, section 15301 because the Project consists of the operation, maintenance, and permitting of an existing water diversion involving no expansion of use. The Project meets the criteria for categorical exemption type Class 2; California Code of Regulations, title 14, section 15302 because the Project consists of the replacement of existing structures (stream crossing culverts) where the new structure will be located on the same site and serve the same purpose as the structure replaced. The Project meets the criteria for categorical exemption type Class 4; California Code of Regulations, title 14, section 15304 because the Project involves minor alteration in the condition of land, water, and vegetation, which does not include the removal of healthy, mature, scenic trees.
