Document Description
Ordinance No. 3962 would amend Article 7 to Chapter 1 of Division 5 entitled Enforcement". In summary, the ordinance would clarify the process of serving violation notices to the operator, owner or pilot of any aircraft found in violation of the City's Airport Ordinance as well as to the hearing process for receiving such violation. The proposed amendments would allow the Notice to Appear letter to be delivered by first class mail at least 25 calendar days before the scheduled hearing date. In addition to the Notice to Appear being served by first-class mail, the City could also deliver it through physical delivery, delivery by overnight carrier service, or delivery by digital mail. Additionally, Ordinance No. 3962 would establish a neutral third party as the Hearing Officer and outlines the Hearing procedures and Hearing Officer's decision. Furthermore, Ordinance No. 3962 provides clarity on applicable Torrance Municipal Code Sections and the parties it could affect (i.e., operator, owner, or pilot of aircraft).

Ordinance No. 3962 was reviewed pursuant to the California Environmental Quality Act (Public Resources Code§§ 21000, et seq., "CEQA") and the regulations promulgated thereunder (14 Cal. Code of Regulations §§15000, et seq., the "CEQA Guidelines"). Ordinance No. 3962 is exempt from CEQA pursuant to CEQA Guidelines Section 15378, because the activity undertaken involves general text amendments to the Torrance Municipal Code that would not cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, as such, Ordinance No. 3962 does not meet the definition of a "Project" under CEQA. Ordinance No. 3962 is also exempt from CEQA pursuant to CEQA Guidelines Section 15061 (b)(3) because it can be seen with certainty that there is no possibility that Ordinance No. 3962 may have a significant effect on the environment. Ordinance No. 3962 would make pre-existing public nuisance regulations more robust and protective of neighboring communities.
