Reasons for Exemption
In compliance with Section 15301 of the California Environmental Quality Act (CEQA) Guidelines, the relocation and expansions of an existing wine tasting room within an existing industrial building, with no expansion of the existing structure is categorically exempt from CEQA under Class 1- Existing Facilities. Section 15301 of the State CEQA Guidelines reads as follows: “Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The types of “existing facilities” itemized below are not intended to be all-inclusive of the types of projects which might fall within Class 1. The key consideration is whether the project involves negligible or no expansion of use.” The proposed relocation and expansion of a wine tasting room in an existing industrial building constitutes an operation within an existing private structure. There would not be any increase in the building square footage and negligible expansion of the existing use. Therefore, the project is exempt from CEQA pursuant to Section 15301 of the State CEQA Guidelines.
