Document Description
The action involves removal of two single-walled 20,000-gallon Jet A fuel underground storage fuel tanks (UST) and one single-walled 12,000-gallon av-gas UST and associated appurtenances. The USTs are located within the boundaries of an inactive landfill (Unit 2). The action is in compliance with Senate Bill 445 and State Water Resources Control Board mandating all single-walled USTs to be permanently removed.

Reasons for Exemption
Section 15301 of CEQA Guidelines exempts from CEQA review actions consisting of the “operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features involving negligible or no expansion of use beyond that existing at the lead agency’s determination.” The key consideration in applying this exemption is whether the proposed action involves expansion of an existing use. In addition, Section 15304 exempts minor public or private alterations to land, including the filling or backfilling of earth into previously excavated land. The proposed action involves removal of existing underground storage fuel tanks with no proposed changes in use from what currently exists and involves no or negligible expansion of use. The proposed action does not trigger exceptions under Section 15300.2 (a) through (f). Accordingly, the action is exempt from CEQA review pursuant to Sections 15301 and 15304 of the CEQA Guidelines.
