Reasons for Exemption
Governor Gavin Newsom’s March 28, 2022 Executive Order (EO) N-7-22 concluded that strict compliance with California Environmental Quality Act (CEQA) would prevent, hinder or delay the mitigation of the effects of significant precipitation. Item 12 of EO N-7-22 requires the State Water Board to prioritize temporary water right permits to accelerate approvals for projects that enhance the ability of a local or state agency to capture high runoff events for local storage or recharge, consistent with water rights priorities and protections for fish and wildlife. This item suspends CEQA, and the regulations adopted pursuant to it, to the extent that CEQA would otherwise apply to actions taken by state agencies for the purposes of carrying out this directive. This temporary permit will enhance the ability of Scott Valley Irrigation District to capture high runoff events for underground storage and groundwater recharge, consistent with water rights priorities and protections for fish and wildlife. Water stored underground under the permit will be used for fish and wildlife enhancement within the service area of the Scott Valley Irrigation District. Accordingly, CEQA is suspended to the extent that it would otherwise apply to this temporary permit.
