Exempt Status
Categorical Exemption
Type, Section or Code
State type and section number: CEQA Guidelines Section 15301, Class 1 (Existing Facilities) and Section 15305, Class 5
Reasons for Exemption
The proposed project has been reviewed in accordance with the California Environmental Quality Act. The City’s Environmental Administrator has determined that the project is categorically exempt from further review under State CEQA Guidelines Section 15301 Class 1. (Existing Facilities) and Section 15305 (Class 5 -Minor Alterations in Land Use Limitations) and there is no substantial evidence demonstrating that an exception to a categorical exemption pursuant to CEQA Guidelines 15300.2 applies. The Class 1 Categorical Exemption allows for the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible pr no expansion of use, and Class 5 allows minor alterations in land use limitations in areas with an average slope of less than 20 percent, which do not result in any changes in use or density.
