Reasons for Exemption
Based on Supporting CEQA Analysis for this Project the proposed project is consistent with the criteria outlined in CEQA Guidelines Section 15061(b)(3) because the activity is covered by the Common Sense exemption that CEQA
applies only to projects which have the potential for causing a significant effect on the environment. The subject parcel is located within Safety Zone 6 of the Porterville Municipal Airport (PTV-4), as designated by the Tulare County Airport Land Use Compatibility Plan (TCAL). According to TCAL, single-family residential uses are considered conditionally compatible within Safety Zone 6. In areas where aircraft noise exceeds 60 dB CNEL, residential structures must comply with California Noise Standards and be designed to achieve an interior noise level of 45 dB CNEL or less. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Section 15061 (b)(3) is applicable and appropriate for PZV 25-047 and PPM 25-044 because the proposed Zone Variance and proposed land division will not make any physical change to the environment and will result in creation of two parcels.
