Pursuant to Public Resources Code Section 2770(h) and consistent with the State Mining and Geology Board’s guidance, approval of an Interim Management Plan is a ministerial action that ensures regulatory compliance during idle periods. Because the Plan is limited to ongoing maintenance and stabilization of an existing mining operation, and does not authorize new construction, expansion, or changes in land use, it is not a discretionary project under CEQA and has no potential to result in a significant environmental effect.
