Notice of Exemption
Exempt Status
Categorical Exemption
Type, Section or Code
Guidelines Section 15315, Minor Land Divisions
Reasons for Exemption
The subject application is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines §15315, Minor Land Divisions. This exemption applies to the division of property in urbanized areas zoned for residential, commercial, or industrial uses into four or fewer parcels when the division is conformance with the General Plan and zoning, no variances or exceptions are required, all services and access to the proposed parcels to local standards are available, the parcel was not involved in a division of a larger parcel within the previous 2 years, and the parcel does not have an average slope greater than 20 percent. The proposed project meets this criteria since (1) the site is within an urbanized area zoned for residential uses, (2) the resulting subdivision will result in four or fewer parcels (total of two parcels), (3) the division is in conformance with the General Plan and zoning for lot requirements and use, (4) no variances or exceptions are required, (5) all services and access to the proposed parcels are available, (6) the parcel was not involved in a division of a larger parcel within the previous 2 years (last subdivided in August 2017), and (7) the parcel does not have an average slope of greater than 20 percent.
Additionally, none of the exceptions set forth in CEQA Guidelines Section 15300.2, which would preclude a project from using a categorical exemption, are applicable, as described below:
a) Minor Land Division projects are classified as Class 15 by the California Secretary for Resources and are not subject to the special circumstances applicable to projects classified as Classes 3, 4, 5, 6, and 11;
b) The cumulative impact from successive projects over time will not be significant because the use is consistent with the allowed and previously anticipated uses for the zone;
c) The proposed activity will not have a significant effect on the environment because the site has been previously developed, and the development is consistent with all development and design standards of the Zoning Code and the Lodestar at Mammoth Master Plan;
d) The site is not adjacent to a scenic highway;
e) The site is not located on a hazardous waste site pursuant to the list of Hazardous Waste Substances maintained by the Town; and
f) There are no known historical resources on the site and therefore there is no possibility of causing a substantial adverse change in the significance of an established historical resource as a result of the project.
