Reasons for Exemption
Pursuant to the California Environmental Quality Act (CEQA), the project qualifies for a categorical exemption under the California Code of Regulations (CCR), Title 14, Division 6, Chapter 3, Section 15301 (e) (Class 1) “Existing Facilities” would be applied to convert an existing 938 square feet ice cream shop to a restaurant with alcohol service, including connecting an existing 318-square-foot-patio, under proposed Minor Use Permit. The preceding section allows additions to existing structures provided they do not exceed 50 percent of the original floor area. The primary structure contains 938 square feet, and the proposed patio connection falls below this 50 percent threshold, qualifying for the exemption.
