The proposed project is categorically exempt from environmental review in accordance with Section 15307 of the California Environmental Quality Act (CEQA) Guidelines and Placer County Code Section 18.36.070 (Class 7 – Actions by regulatory agencies for protection of natural resources) and statutorily exempt in accordance with Section 15269(c) of CEQA and Placer County Code Section 18.36.010 (Statutory Exemptions – Emergency Projects) because the sheet pile wall is an emergency measure necessary to ensure a pit capture event does not occur. If the riverbank erodes to the point of failure, impounded water in a 70-acre mine wash water settling pond would be released into the river system in an uncontrolled flood event resulting in potentially catastrophic downstream flooding and property damage.
