Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
CEQA Guidelines Section 15301 - Existing Facilities, 15305 - Minor Alterations to Land Use Limitations
Reasons for Exemption
The current request (PLNP2025-00206) includes a request for a minor use permit to allow an existing general agricultural structure to deviate from side yard setback requirements in the AR-2 zoning district. Being that the structure is an existing facility on the site, it is compliant with Class 1 criteria and is exempt from the provisions of CEQA. Class 5 consists of minor alterations in land use limitations in areas with an average slope of less than 20% which do not result in any changes in land use or density, including but not limited to minor lot line adjustments, side yard, and setback variances not resulting in the creation of any new parcel, issuance of minor encroachment permits, and/or reversion to acreage in accordance with the Subdivision Map Act. The allowance of the structure is consistent with adjacent properties and will not result in any changes to land use allowances or density; therefore, the project is exempt from the provisions of CEQA.
