Document Description
Permit Adjustment to PD 1319 (as modified by LU06-0062,
LU06-0136, PL16-0175, and PL24-0084), that allows for a business engaged in
Warehousing and Storage of shipping containers in addition to retaining the
approval to conduct Manufacturing Industries – Metal Products with an accessory
use of Retail Sale of Products Manufactured On-Site to operate on a 3-acre portion
of the lot sited directly east of the existing Tidwell Excavating operation. The PAJ
also allows for the construction of a one story, 400 square-foot office, 4,200
square-foot open prep area, and a 160 square-foot Cargo Container to store
household cleaning supplies to support the operation. The operation involves the
storage, cleaning and leasing sale of empty shipping containers.
All containers stored onsite will be empty and stored in conformance with the
Ventura County Fire Protection District’s regulations. Containers will be stacked in
accordance with the height limits specified on the site plans stamped as Exhibit 2
and screened from view pursuant to Condition No. 18. The remainder of the project
site will continue to be used for Contractors’ Service and Storage Yards and
Buildings (offices, storage, etc.) related to the Tidwell Excavating operation as
described in Condition No. 78 of PAJ Case No. PL16-0175.

Reasons for Exemption
Permit Adjustment for Conditional Use Permit (CUP) PD 1319 Case No. PL25-0104 is
exempt pursuant to CEQA Guidelines Section 15303, Class 3 (New Construction or
Conversion of Small Structures) because the project consists of the construction and
operation of a 400-square-foot office, a 4,200-square-foot open prep area, and a 160-
square-foot cargo container for storage of household cleaning supplies to support
warehousing and storage of shipping containers, while retaining the option for metal
product manufacturing with accessory on-site retail sales, on an approximately 3-acre
portion of an existing industrial site. The project represents a limited number of small
commercial structures and appurtenant facilities within an already developed and
disturbed industrial property that is served by existing public services and utilities, and
it does not involve the use of significant amounts of hazardous substances. As such,
the project is consistent with the types of small commercial structures and accessory
facilities described in CEQA Guidelines Section 15303(c) and (e).
