Reasons for Exemption
The proposed Lease with Star View involves the ongoing use of an existing facility and no expansion of its current operations. Star View has been occupying the Property since 2021. The Lease is not a project under CEQA because it is an activity that is excluded from the definition of a project by section 21065 of the Public Resources Code and is an administrative activity of government under section 15378(b) of the State CEQA Guidelines since the action would not result in direct or indirect physical changes to the environment. In the alternative, the proposed activity is categorically exempt from CEQA pursuant to section 15301 of the State CEQA Guidelines (Existing Facilities) and Class 1 of the County's Environmental Document Reporting Procedures and Guidelines, Appendix G, which applies to operation, leasing, and minor alteration of an existing facility with negligible or no expansion of use. In addition, based on the record of the proposed activity, it will comply with all applicable regulations, and there are no cumulative impacts, unusual circumstances, damage to scenic highways, listing on hazardous waste site lists compiled, pursuant to Government Code Section 65962.5, or indications that it may cause a substantial adverse change in the significance of a historical resource that would make the exemption inapplicable.
