To authorize an existing power pole, well, pump, three sand media filters, and footing pad that are associated with a six-inch steel irrigation pipe that is currently permitted under Permit No. 11540 and 11540-A, and to construct a timber-framed shade structure and up to six raptor perches and barn owl boxes. This permit supplements and, where in conflict, supersedes Permit No. 11540 and Permit No. 11540-A that were issued to Wilearlee Walnuts in 1976.

The project is located on the landside of the left bank levee of the Sacramento River, within and on the west edge of the Butte Basin, along River Road, approximately 12 miles north of the City of Colusa. More specifically, the property is within Section 6 of Township 17 North, Range 1 West, Mount Diablo Base and Meridian and is within the Moulton Weir U.S. Geological Survey 7.5-minute quadrangle. It is identified as Assessor’s Parcel Number 012-170-032, Sacramento River and Butte Basin, Colusa County (39.356603°, -122.008859°).

Reasons for Exemption
The Board has determined that the project is exempt from CEQA under the Class 1, Existing Facilities categorical exemption (CEQA California Code of Regulations, Title 14, Section 15301), because the activity consists of the operation, repair, maintenance, permitting, or minor alteration of existing private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use. No expansion of existing or former use will occur. The project is exempt from CEQA under the Class 3, New Construction or Conversion of Small Structures categorical exemption (CEQA California Code of Regulations, Title 14, Section 15303), because the activity consists of construction and location of limited numbers of new, small facilities or structures, and installation of small new equipment and facilities in small structures. Further, none of the exceptions to the exemption in CEQA California Code of Regulations, Title 14, Section 15300.2 apply. The Board has determined that an application to change the name of the permittee does not have the potential to result in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and thus, is not a “project” for purposes of the California Environmental Quality Act (CEQA Public Resources Code Section 21065; CEQA California Code of Regulations, Title 14, Section 15378(a)).
