Document Description
The subject property is listed on the County’s Housing Element Sites Inventory with the development potential of 170 units for moderate-income, low-income, and very-low-income households. The project site is located in an HE-C, Housing Element Consistency zoning district. The applicant requests approval of an HE-C Development Plan permit to allow the construction of the “Harbor Pointe at Discovery Bay” multi-family residential rental project. The project proposes the construction of 170 residential units, a clubhouse, a maintenance building, and trash enclosures, and other residential improvements including landscaping, a dog park, picnic, and play areas. 168 residential units, consisting of a variety of one-, two-, and three-bedrooms, would be in seven, three-story buildings, each up to approximately 38 feet in height. These 168 residential units include 133 residential units that will be rented to lower-income households and 35 residential units that will be rented to very low-income households. Two (2) residential units are designated manager’s units and would be located in the two-story clubhouse building. The project would provide 305 off-street surface parking spaces, of which 114 would be covered by solar canopies (carports), and 73 long- and short-term bicycle parking spaces. Up to 40 trees would be removed for grading and construction. Grading would consist of approximately 4,500 cubic yards (CY) of cut and 3,000 CY of fill for a net 1,500 CY cut. Retaining walls, drainage, and utility extensions for water, sewer, electric, etc. are also proposed.

Reasons for Exemption
The project is statutorily exempt under CEQA Guidelines, Section 15268, regarding “Ministerial Projects,” which exempts projects that involve no discretionary or subjective judgement by a public agency. The proposed development satisfies the requirements for ministerial approval without discretionary review or public hearing in accordance with County Ordinance Code, Section 84-92.806 and Government Code, Section 65583.2(h). Government Code section 65583, subsections (h) and (i), define such qualifying developments as a “use by right” and, specifically, not a project for purposes of CEQA. The proposed development to construct a 170-unit apartment complex is consistent with the objective design standards, densities, and requirements of the County’s Housing Element Consistency (HE-C) zoning district that apply to the subject property. Therefore, the proposed development is a use by right that qualifies for ministerial approval and is not a project for purposes of CEQA. Section 21080(b)(1) of the Public Resources Code also provides that CEQA does not apply to ministerial projects and, thus, none of the exceptions to categorical exemptions listed in CEQA Guidelines, Section 15300.2, apply to the project.
