Document Description
The proposed project will operate a retail business out of an existing facility located at 1911 Fairway Drive, San Leandro, CA 94577 (APN 77A-646-17-2). The building is 13,015 square feet, with 5,500 square feet designated for a dispensary, on 0.37 acres. The neighborhood is zoned for Commercial Stores and Retail Outlets. The single-story industrial building was constructed in 1968, located on the corner of Fairway Drive and Nicholson Street and east of HWY 80. The existing site is fenced in front of the building with a landscape setback. The site has a parking lot with ingress and egress points on both Fairway Drive and Nicholson Street. Two of the driveways lead to alleyways along the side and rear of the building. The alley at the rear of the building is shared with adjacent property on Nicholson Street.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is a Class 1 Categorical Exemption Project. Class 1 Categorical Exemptions consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alterations to existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. The Project involves the use of an existing building with no proposal for building expansion. The design, location, size, and operating characteristics of the Project are compatible with the existing and future land uses within the vicinity as it is zoned light industrial zoned. None of the exceptions to the exemption defined in Section 15300.2 apply to the Project.
