Reasons for Exemption
California Public Resources Code section 21080.35 was modified in 2011 pursuant to SB 226 to provide statutory exemption from the requirements of CEQA for the installation of solar energy systems that meet the criteria of PRC 21080.35. In addition to the statutory exception cited above, the project is categorically exempt from the California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15301: Class 1 Existing Facilities because the Project would involve no expansion of use. The Solar arrays will be in an area where no environmentally sensitive habitat exits, i.e. an existing overflow parking area.
