Document Description
Phase 1 will include validation of the condition of the Long Outfall and evaluation of the condition of the Short Outfall. This will involve utilizing divers and Remotely Operated Vehicles to verify the scope of work required for rehabilitation for the Long Outfall and to identify any structural issues, interior blockages, or areas that require repair and rehabilitation for the Short Outfall. There will be collection and testing of samples from internal outfall sediments for both outfalls. It will include design of the closure of the eight rectangular ports and short-term and long-term rehabilitations of marine portion of the Short Outfall, and for the Long Outfall there will be design of rehabilitation of marine portion.

Reasons for Exemption
Phase 1 is exempt from CEQA under Class 1 and Class 6 categorical exemptions set forth in California Code of Regulations sections 15301 and 15306. Section 15301 (Class 1) exempts from CEQA “the operation, repair, maintenance … or minor alteration of existing public or private structures, facilities … involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination” including “(b) Existing facilities of both investor and publicly-owned utilities used to provide electric power, natural gas, sewerage, or other public utility services.” Section 15306 (Class 6) consists of basic data collection, research …which do not result in a serious or major disturbance to an environmental resource. These may be strictly for information gathering purposes, or as part of a study leading to an action which a public agency has not yet approved, adopted, or funded. Phase 1 of the project is exempt because it’s information gathering to determine the repair, maintenance, and/or replacement of existing facilities involving no expansion of use or capacity.
