Reasons for Exemption
Pursuant to the California Environmental Quality Act (CEQA) and the State CEQA Guidelines, the minor modification is categorically exempt from CEQA under Guidelines Class 1 Section 15301, Existing Facilities (e)(2). Special Use Permit No. PSP 18-061 was approved in conjunction with a Categorical Exemption. The Planning Commission found that said Special Use Permit was Categorically Exempt, consistent with the California Environmental Quality Act (CEQA) and the State CEQA Guidelines pursuant to Title 14, Cal. Code Regulations, Section 15061 (b)(3), the General Rule; Section 15301 - Existing Facilities; and Section 15303 - New Construction or Conversion of Small Structures. The General Rule pertains to a project that does not have the potential for causing a significant effect on the environment and, therefore, is not subject to CEQA. The basis for the exemption is that the facility will utilize existing structures and no manufacturing takes place on the site. Approximately 3,000 square feet of new structures will be constructed. The agricultural chemicals warehoused on the site are not hazardous, explosive, volatile or poisonous. The maximum 20 daily trips fall significantly below the San Joaquin Valley Air Pollution Control District's Small Project Analysis Level of 1,506 trips. The site is approximately 800 feet from the nearest neighboring residence, minimizing any nuisance or noise. The commercial project has all necessary public services and facilities. The subject site is not located inan environmentally sensitive area and is surrounded by agriculture, agriculture-related facilities, and rural residential uses. Conditions of approval were included.
Minor Modification No. MIM 25-051, to add an adjacent parcel (APN 150-090-026) and storage building to the existing Agricultural Chemical Facility, can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This is because the existing Agricultural Chemical Facility has already gone under CEQA review with the approval by Special Use Permit No. 18-061 (PC) with an approved Categorical Exemption, and this Minor Modification is merely updating the site plan to add an adjacent parcel and a storage building to the site plan. Therefore, the application of CEQA Class 1 Section 15301, Existing Facilities (e)(2) is applicable and appropriate for this project.
