Reasons for Exemption
Section 15301(b) & (d)
The CEQA Guidelines of Section 15301 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. Section 15301(b) includes existing facilities of both investor and publicly owned utilities used to provide electrical power, natural gas, sewerage, or other public utilities. Section 15301(d) includes the restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety, unless it is determined that the damage was substantial and resulted from an environmental hazard such as earthquake, landslide, or flood, which these facilities have not.
Section 15302(c)
The CEQA Guidelines of Section 15302 consists of the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the replaced structure and will have substantially the same purpose and capacity as the structure replaced. Section 15302(c) includes the replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity.
