Document Description
This project will install, operate, and maintain four public electric vehicle (EV) direct current fast charging (DCFC) ports at three sites in California under the National Electric Vehicle Infrastructure Formula Program. All DCFC charging ports will be operated and maintained in accordance with the requirements in Title 23, Code of Federal Regulations, Section 680. Reasons for Exemption
Cal. Code Regs., tit 14, sec. 15301 provides that projects that consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use, are categorically exempt from the provisions of CEQA. This project involves the installation of 12 EV charging ports across three sites in San Joaquin, Santa Clara and Riverside counties, along State Routes 4, 17, and 79. Each site is located within an existing, paved parking lot on commercial property. No historic buildings or resources will be impacted by the project. Minor modifications to the sites may be needed such as installing electrical equipment including a transformer and switchgear, trenching to install electrical conduit to connect the transformer and switchgear to the utility connection. Because the existing sites of the project have been previously developed with minor alterations included, this project involves negligible or no expansion of existing or former use and will not have a significant effect on the environment. Therefore, this project is exempt under section 15301.
Cal. Code Regs., tit. 14, sec. 15303 provides that projects which consist of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure, are categorically exempt from the provisions of CEQA. The project will involve installing 12 EV charging ports and associated small-scale equipment, such as power cabinets, switchgear, and transformers, within an existing developed area. Because this project consists of the construction and location of limited numbers of new, small structures and/or the installation of small new equipment in small structures with only minor modifications to the structures, this project is exempt under section 15303.
Additionally, the project does not involve any unusual circumstances, will not result in damage to any scenic resources within a highway officially designated as a state scenic highway, none of the sites are included on any list compiled pursuant to Government Code section 65962.5, and the project will not cause a substantial adverse change in the significance of a historical resource. The project, when considered as a whole, will not result in a cumulative impact that is significant on the environment. Therefore, none of the exceptions to exemptions listed in CEQA Guidelines section 15300.2 apply to this project and this project will not have a significant effect on the environment.
