Reasons for Exemption
Pursuant to the California Environmental Quality Act (CEQA), the adoption of the Ordinance implementing the City's objective design standards does not constitute a "project" within the meaning of Public Resources Code Section 21065, 14 Cal. Code Regs. Section I 5060(c)(2) because it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. Even if the adoption of the Ordinance implementing the objective design standards did constitute a project under CEQA, the Ordinance is exempt from the CEQA pursuant to State CEQA Guidelines Section 15061 (b)(3) (the "common sense" exemption), which excludes projects where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. The proposed Ordinance introduces objective design standards but does not alter any underlying density or height limitations, and will not allow any development that is not consistent with existing City codes, standards, or policies, and therefore it can be seen with certainty that the recommended Ordinance could not have a physical effect on the environment. Therefore the proposed Ordinance does not warrant further environmental review
