Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement EPIMS Notification No. EPIMS-MEN-51960-R1C, pursuant to Section 1602 of the Fish and Game Code to Terry Schauer.
The Project is limited to one encroachment. The proposed encroachment is to remove a spillway culvert and outlet chute from an on-stream pond and install a new spillway culvert. The new spillway will have an appropriately sized culvert and downspout that will 1) be in line with the outlet stream channel, 2) will discharge past the toe of the pond embankment, and 3) create 2 feet of freeboard in the on-stream pond. The outlet stream channel and banks will be armored with appropriately sized riprap rock to address ongoing erosion. Work for this encroachment will include excavation, removal of the existing culverts, replacement with new properly sized culvert, backfilling and compaction of fill, and rock armoring as necessary to minimize erosion. All work will be completed as specified in the most recent version of the Notification submitted on August 15, 2025.

The Project meets the criteria for categorical exemption type Class 4, California Code of Regulations, title 14, section 15304 because the project consists of minor private alterations in the condition of land and water which does not involve removal of healthy, mature, scenic trees.
