The project is exempt from CEQA pursuant to CEQA Guidelines Sections 15061(b)(3), 15307, and 15308. Section 15061(b)(3) - General Rule (Common Sense Exemption): The activity is covered by the common sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. It can be seen with certainty that there is no possibility that the proposed ordinance may have a significant effect on the environment. The ordinance consists solely of regulatory text amendments that establish procedural and administrative standards without authorizing any specific physical development or construction. Section 15307 - Actions by Regulatory Agencies for Protection of Natural Resources: The project consists of actions taken by a regulatory agency as authorized by local ordinance to assure the maintenance, restoration, or enhancement of natural resources where the regulatory process involves procedures for protection of the environment. The ordinance establishes enhanced regulatory standards for BESS facilities to protect natural resources through improved siting, operational, and safety requirements.
