Document Description
The City of Newport Beach proposes to construct two water wells to an approximate depth of 700 feet and 300 feet. Once completed, the water wells will be connected to the City of Newport Beach’s existing water mains located in the Talbert Channel. Both wells and related equipment will be housed within a 2,400 square foot structure that is 15 feet tall. The project also includes constructing a 24-inch water main within the Bushard Street and Talbert Avenue rights-of-way, and an 18-inch reinforced concrete storm drain in the Bushard Street right-of-way. Pursuant to CEQA Guidelines §15051, the City of Newport Beach is the lead agency for this project.

Reasons for Exemption
The project qualifies for a Class 32 categorical exemption pursuant to Section 15332 (Class 32, In-Fill Exemption) of Title 14 of the California Code of Regulations (14 CCR § 15332) for the following reasons: The project site, including work within the rights-of-way are less than five acres; within an incorporated City; consistent with Fountain Valley’s general plan; does not contain habitat for endangered, rare or threatened species; will not result in significant effects relating to traffic, noise, air quality, or water quality; and can be served by all utilities. Furthermore, the project does not meet any of the exceptions to exemptions listed in CEQA Guidelines §15300.20.

Reasons for Exemption
A water well permit will be issued by the City of Fountain Valley; however, this permit is ministerial and does not require any discretion on part of the City of Fountain Valley. As such, the issuance of these permits are statutory and categorically exempt pursuant to Section 21080(b) of the California Public Resources Code (PRC § 21080(b)) and CEQA Guideline Sections 15268 and 15300.1 (14 CCR § 15268 and 14 CCR § 15300.1).
