Document Description
The Project will consist of growing 9,996 square feet of mature and 2,448 square feet of immature cannabis within hoop houses and without the use of artificial lighting. Other activities take place within support structures and include onsite composting, pesticide and harvest storage, processing and packaging. No other cannabis projects are proposed onsite. There is one expired (exp 11/26/2024) Small Mixed-Light Tier 1 license on the same APN under a different business name (Gaudy Farms LLC). Water for cannabis activities will be supplied by a permitted on-site well and use of no more than 150,000 gallons of water per year is proposed. An existing septic system will be used for sewage disposal. Energy for cannabis activities will be provided by on site solar panels. Applicant doesn’t intend to use local utility PG&E for cannabis activities. The California Department of Fish and Wildlife (CDFW) reviewed the initial application and determined that a Lake or Streambed Alteration Notification is not required (EPIMS-NEV-58918-R2). Applicants meets waste discharge requirements per Water Quality Order WQ 2023- 0102-DWQ (WDID # 5S29CC461874). Local CEQA approval has been confirmed via Certified EIR that analyzes the zoning ordinance, project specific 15183 exemption checklist and Notice of Conditional Approval. Local CEQA approval is aligned with the DCC application. It has been noted that local approval states it is for a mixed-light license even though the applicant is not proposing the use of artificial lights for mature cannabis cultivation. Nevada County mixed-light approval covers DCC outdoor licenses.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is consistent with the local jurisdiction community plan and/or zoning designations. On May 14, 2019, Nevada County Resolution No. 19-199 certified a Program Environmental Impact Report (PEIR; SCH #2018082023) for the Nevada County Commercial Cannabis Cultivation Ordinance. On January 10, 2023, the Nevada County Board of Supervisors adopted an Addendum to the certified PEIR which analyzed potential impacts associated with amendments to the Nevada County Commercial Cannabis Cultivation Ordinance. CEQA mandates that the project is consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified and shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site. The project activity fits within the parameters included in CEQA Guidelines Section 15183 and the activity does not require additional CEQA analysis.
