Document Description
The California Department of Fish and Wildlife has amended Streambed Alteration Agreement No. 1600-2019-0175-R5, pursuant to Section 1602 of the Fish and Game Code to Ventura Regional Sanitation District as represented by Edward Pettit. The project is limited to the maintenance of two drains that discharge run-off from the Bailard Landfill to the Santa Clara River. The project has been amended to include a revised mitigation measure for southwestern pond turtle to aid in the protection of the species. The Permittee was also amended from Mark Potter to Edward Pettit to represent the Ventura Regional Sanitation District (Organization). Finally, the Organization’s address was updated as part of the amendment. Public Agency Approving Project

Reasons for Exemption
On April 20, 2009, the Ventura Regional Sanitation District, the Lead Agency, determined that the project is Categorically Exempt pursuant to California Code of Regulations, title 14, section 15301, Existing Facilities. Class 1 consists of operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use. Under Public Resources Code section 21080.1(a), the lead agency is responsible for determining if the project is exempt from CEQA and that determination shall be final and conclusive on all persons, including responsible agencies. As a result, CDFW, acting as Responsible Agency, is bound by the Ventura Regional Sanitation District’s determination that the project is exempt.
