Document Description
The vacation of the terminus last 1,000 feet of Morrison Canyon Road process was initiated through a formal application by the property owner and a petition submitted by members of the public. The Alameda County Public Works Agency proposed to vacate a portion of the County’s right-of-way interest in the final 1,000 feet of Morrison Canyon Road, located in the unincorporated Alameda County. The County maintained this segment as a public roadway under an easement. The proposed vacation would extinguish the County’s roadway easement while reserving a public utility and access easement to maintain service continuity for existing utilities. On June 16, 2025, the Alameda County Planning Commission, under General Plan Conformance Resolution PLN-00076 (Resolution No. 25-06), determined that the proposed right-of-way vacation is consistent with the goals and policies of the East County Area Plan. The Alameda County Board of Supervisors’ resolution approved the proposed vacation, full property rights will revert to the underlying fee owner as soon as the Resolution 2025-411 dated September 11, 2025 is recorded. With the recordation of the Resolution, the County's responsibility for maintenance and operation of this segment will cease. The property owner will assume future maintenance obligations including the reserved public utility and access easement. This proposed action will not authorize or facilitate any construction or development activities. The vacation, as proposed and conditioned, will not result in direct, indirect, or cumulative physical environmental impacts.

Reasons for Exemption
The activity is covered by Section 15061 (b)(3), the Common Sense exemption on the grounds that it can be seen with certainty that there is no possibility that the activities in question may have a significant effect on the environment, the activity is not subject to CEQA. The exemption is appropriate because the activity is a right of way being vacated by the County. Since the activity itself is only a change in title, this activity will not create significant traffic, or vehicle miles traveled, nor will it create any significant effects regarding cumulative impacts, hazardous material, cultural or biological resources, and no more so than had it remained a County road. Therefore, the County as lead agency can say with certainty there is sufficient evidence, logically and by the mere nature of the activity, to conclude that there will not be a significant effect on the environment as defined under State CEQA 15061 (b)(3).
