The ordinance is exempt from the requirements of CEQA pursuant to CEQA Guidelines sections 15307 and 15308 as an action by a regulatory agency taken to protect the environment and natural resources. The ordinance is exempt from the requirements of CEQA pursuant to CEQA Guidelines sections 15301(a) because the ordinance impacts existing buildings only and involves alterations that do not result in an expansion of use. This ordinance is more protective of the environment than the state standards, so there is no possibility that the ordinance will have a significant effect on the environment. The ordinance helps the City of Sunnyvale to assure the maintenance, restoration, enhancement, and protection of the environment and Sunnyvale’s natural resources by requiring energy efficiency standards for existing building remodels, additions, and alterations.
