Reasons for Exemption
Pursuant to the California Code of Regulations, Title 14, Division 6, Chapter 3, Article 19, Section 15301 Class 1-Existing Facilities would be applied to the proposed project. Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The key consideration is whether the project involves negligible or no expansion of use. The project site is located in a previously developed parcel. The building that would be used for the proposal is existing (built approximately in the mid-1990s) and the applicant does not propose to expand the footprint of the existing building. The facility was previously used for industrial manufacturing of cannabis, and prior to that manufacturing shower doors and enclosures.
