Document Description
City Council adoption of a new Solid Waste Management Fee and associated fee schedule for City-provided solid waste management services. The Solid Waste Management Fee schedule includes four effective dates (I.e., July 1, 2025; July 1, 2026; July 1, 2027; and July 1, 2028). The adoption of the Solid Waste Management Fee and associated fee schedule will fund various solid waste management services and operational expenses which could Include, but are not limited to, weekly recycling collection, curbside bulky item pick up, waste collection equipment and fleet replacement, and additional staffing. Approval of the Solid Waste Management Fee and associated fee schedule will reduce the obligation the General Fund would otherwise incur for waste collections operations. A portion of the General Fund dollars allocated for solid waste collection services will be used to provide a financial assistance program for customers. The collection of the new Solid Waste Management Fee could potentially occur through the use of tax roll billing which will be decided at a later City Council hearing. The Recycling Enterprise Fund will be used to support a portion of the costs of providing residential collections services (for recycling operations only) through Fiscal Year 2030. This will be gradually reduced and phased out by Fiscal Year 2031. A new enterprise fund, the Solid Waste Management Fund, will house revenue received from the new Solid Waste Management Fee. The revenue can be used only to cover the costs of City-provided solid waste management services. The Solid Waste Management Fee will become effective on July 1, 2025 and a new customer-facing portal will become available for property owners to select and manage their containers by July 15, 2025.

Reasons for Exemption
The proposed action to adopt a new Solid Waste Management Fee is exempt from CEQA pursuant to CEQA Guidelines Section 15273 (Rates, Tolls, Fares, and Charges) which exempts the establishment, modification, structuring, restructuring, or approval of rates, tolls, fares, or other charges by public agencies that the public agency finds are for the purpose of: 1) meeting operating expenses, including employee wage rates and fringe benefits, 2) purchasing or leasing supplies, equipment or materials, 3) meeting financial reserve needs and requirements, or 4) obtaining funds for capital projects necessary to maintain service within existing service areas. The adoption of the new Solid Waste Management Fee will allow the City to collect funds to recover the costs of providing solid waste management services and meet operational expenses and financial reserve needs; purchase and/or lease new supplies, equipment or materials to improve safety and operational efficiency; and will provide funds for capital projects necessary to maintain and enhance solid waste management services within the existing service areas. Thus, this action meets the criteria for an exemption pursuant to CEQA Guidelines Section 15273. R-316259
