Document Description
The project involves furnishing all labor, materials, equipment, services, and construction for crack sealing on existing paved roadways. In various areas throughout the City of San Diego. The scope of work Includes: 1) crack sealing over 77 miles of streets; 2) traffic control, including obtaining traffic control permits; 3) cleaning cracks using a hot compressed air lance (HCL); and 4) storm drain inlet protection. Night and weekend work may be required. All work would occur within the public right-of-way (paved streets) or in previously disturbed non-sensitive areas only, and outside of the City's Multi-Habitat Planning Area (MHPA). No sensitive vegetation would be impacted or removed. Storm Water Best Management Practices (BMPs) for erosion control preventing discharge, as well as Traffic Control Plan (TCP) would be implemented throughout construction.

Reasons for Exemption
The City of San Diego conducted an environmental review and determined the project is exempt from CEQA pursuant to CEQA Guidelines Section 15301(c) (Existing Facilities), which exempts the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use; and it will involve existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, as well as other alterations such as the addition of bicycle facilities, including but not limited to bicycle parking, bicycle-share facilities and bicycle lanes; Section 15302 (Replacement or Reconstruction), which exempts the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced, the exceptions listed In CEQA Guidelines Section 15300.2 would not apply in that no cumulative impacts were identified, no significant effects on the environment were identified, the project is not adjacent to a scenic highway, and no historical resources would be affected by the action. As to the exception for hazardous materials, there are locations identified on GeoTracker and EnvlroStor within 1,000 feet of the public right-of-way. While these locations are listed, the proposed project would not involve ground disturbance which would expose potential hazardous materials, and as such would not preclude the use of a CEQA exemption pursuant to Section 65962,5 of the Government Code.
