Reasons for Exemption
The Planning Commission reviewed the project’s environmental impacts under the California Environmental Quality Act (California Public Resources Code Section 21000, et seq., “CEQA”) and the regulations promulgated thereunder (14 California Code of Regulations Section 15000, et seq., the “CEQA Guidelines”) and finds the project to be exempt under a Class 32 Categorical Exemption pursuant to section 15332 (Infill Development Projects) of the CEQA Guidelines (Title 14, Chapter 3 of the California Code of Regulations). Further, no exceptions to the exemption apply; there is no reasonable possibility that the activity will have a significant effect on the environment due to unusual circumstances. The site is already developed with a building and the development of a food hall with alcohol sales in conjunction with a sit-down restaurant is compatible with the area.
