Reasons for Exemption
The project is exempt from CEQA under the Class 2 and Class 5 categorical
exemptions set forth in California Code of Regulations sections 15302 and 15305. Section 15302 (Class 2) exempts from CEQA the “replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced, including but not limited to: . . . (c) Replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity.” Section 15305 (Class 5) exempts from CEQA minor alterations in land use limitations in areas with an average slope less than 20%, which do not result in any changes in land use or density, including but not limited to: (a) Minor lot line adjustments, side yard, and set back variances not creation of any new parcels. As indicated above, the project consists of the removal, replace and relocation of a fence. The project is exempt under section 15302 and 15305 as the fence will be in close proximately to the fence removed with only a minor lot line
adjustment, and 2) will continue to have the same purpose and capacity following the completion of the project.
