Document Description
The proposed action consists of issuance of two new 50-year leases with Palomar Airport Road 2006 LLC (lessee). The new leases would allow the lessee to amortize on the previous capital improvements done to their premises and to perform additional new long-term sustainability-related improvements, including the installation of photovoltaic cells for lessee’s premises and electric car charging stations; and a fuel farm, consisting of two 20,000-gallon fuel tanks, offering the use of Sustainable Aviation Fuel. The action is related to continued leasing and operation by an existing leasehold, involving no expansion of leasehold’s premises, and allowing continued use of premises that are restricted to existing uses. The two new aviation leases would commence on November 1, 2025, and terminate on October 31, 2075.

Reasons for Exemption
Section 15301 of the California Environmental Quality Act (CEQA) Guidelines exempts from CEQA review actions consisting of the “operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features involving negligible or no expansion of existing or former use.” The key consideration in applying this exemption is whether the proposed action involves expansion of an existing use. The proposed action involves approval of two new leases with an existing lessee, for continuation of existing uses of facilities and business operations, involving no or negligible expansion of use, and is, accordingly, exempt from CEQA review pursuant to Section 15301 of the CEQA Guidelines. Any future capital improvements that would be subsequently proposed by the lessee and approved by the Director of Airports would be subject to the CEQA review, as applicable.
