The adoption of amendments to the Local CEQA Guidelines is categorically exempt from review under the California Environmental Quality Act ("CEQA") under CEQA Regulation 15308 (Class 8), an action taken by a regulatory agency (i.e., the City) as authorized by state law (i.e., California Public Resources Code Section 21082) to assure the maintenance, restoration, enhancement, or protection of the environment. This activity is also covered by the common sense exemption in CEQA Regulation 15061(b)(3) that CEQA applies only to projects which will have the potential for causing a significant effect on the environment. Here, it can be seen with certainty that there is no possibility that the adoption of amendments to the City's Local CEQA Guidelines may have a significant effect on the environment.
